Senate Bill 436 Passes But With Controversy

Republican Senators at the Indiana Statehouse passed a bill in committee that would allow the attorney general power to supersede county prosecutors. Senate Bill 436 was approved in committee without any testimony in favor.

It would give the attorney general the ability to pursue a local case that a county prosecutor has used their lawful discretion not to prosecute. And it would force the county to pay for the prosecution. The bill was written by Senator Michael Young of Indianapolis.

County prosecutors are elected locally in the county they serve and have
wide-ranging discretion as the chief law enforcement officer of a county.
Senator Karen Tallian represents portions of Porter and LaPorte Counties.

She says the bill completely ignores the votes of Hoosiers and throws
aside prosecutorial discretion, and allow the attorney general to make counties foot the bill for whatever local policy they decide to pursue.
